The Constitutional Court decided in favor of a homosexual man from the city Barranquilla, (col) who was the victim of verbal aggressions of his neighbors. The Court held that this language is offensive and undermines diverse sexual orientation. "You are a gay and gays fly". This was one of the phrases that a man in his residential group in Barranquilla heard every day. The victim filed an acción de tutela , and argued that his neighbors were violating his rights to non-discrimination, equality, the free development of personality and human dignity. The Court held that the rude and offensive language used to describe or offend a homosexual person is an act of discrimination. The Court also recalled that the LGBT community in the country is constitutionally protected and that this type of discriminatory acts are against of the legal system and are unacceptable.
